Woman In Sex Case Given Probation

MIDDLETOWN - Before a Superior Court judge sentenced a Cape Cod woman on Friday for having a sexual encounter with a 15-year-old, he chided her for making "some of the wrong decisions."

"You're still very young, but you're not a kid," Judge Frank A. Iannotti told Sarah Colby, 25. "It's time for you to start making some of the right decisions."

Police say Colby, of Dennis, Mass., drove over 100 miles to have a sexual encounter with a then-15-year-old male in a Cromwell hotel last year. Police charged her with second-degree sexual assault and risk of injury to a minor, but Colby pleaded guilty to lesser charges of fourth-degree sexual assault and using a computer to entice a minor.

Iannotti spared Colby a jail term but sentenced her to 10 years of probation. Colby also must register in Connecticut as a sex offender for at least 10 years.

During her probation, Colby must submit to polygraph tests and mental health and drug evaluations.

Colby also cannot have contact with minors under the age of 16, and cannot use a computer or the Internet at home. Iannotti ruled Colby could use a computer and the Internet at work or school as long as the use pertained to her job or her studies.

Iannotti also said Colby could continue to care for her 5-year-old child. "There is no indication in any of the reports that her 5-year-old daughter would be jeopardy," he said.

If she violated the terms of her probation, Colby could serve up to five years in prison.

Colby, wearing a purple blouse and black pants, nodded meekly when the judge asked if she understood the terms of her probation.

Colby's attorney, Martin McQuillan, said his client had been attending counseling sessions over the past year.

According to the arrest warrant, Colby met the juvenile victim, who is from New Britain, in January or February of last year through a mutual friend.

Colby and the victim kept in touch through MSN Messenger, MySpace.com and cellphone conversations. They subsequently discussed fooling around sexually and traded nude photos of each other over the Internet, according to the warrant.

According the warrant, Colby began to develop feelings for the victim and arranged to meet him in Cromwell on July 30, 2006. She booked a room at the Comfort Inn at 111 Berlin Road.

Colby drove to Cromwell with the mutual friend and picked up the victim, who was at a family picnic. After spending the day together, Colby, the victim and the friend drove to the Comfort Inn at about 9 p.m., according to the warrant.

There, police said, Colby and the victim had a sexual encounter while the friend napped.

The victim's mother contacted New Britain police when her son did not return home that night. When he came home the next morning, the mother told police she noticed a mark on his neck. The victim told his mother what had happened, and she contacted New Britain police again. Cromwell police arrested Colby on Aug. 16, 2006.

On Friday, Iannotti left Colby with a warning: "Some people are fortunate enough to get second chances," he said. "Not many people get a third chance."

Records: Ex-Officer Almost Was Fired

WINDSOR LOCKS - A former police officer who reached a settlement with the town earlier this year was facing termination after forgetting his gun in various places while on duty and leaving sensitive paperwork around the department, according to records released to The Courant.

William Rousseau, who was hired as a full-time patrol officer in 1983, forgot to re-holster his Glock pistol at least three times in 2005, once leaving his gun on the front seat of the police chief's patrol car, according to Rousseau's file with the police department. He also left police reports, containing some private information, in areas of the police station that civilian workers could access, records show.

Police Chief John Suchocki recommended that the police commission fire Rousseau in September 2006, but the town ultimately reached a settlement with Rousseau, 59, for $110,000. Residents approved the settlement in a town meeting in July, but details of Rousseau's case were not made available during the meeting.

Under the settlement, the 23-year police veteran officially retired from the department at the end of July, said Rousseau, who argued that the town unfairly fired him without giving him the opportunity to remedy his mistakes.

He admits he occasionally forgot to secure his gun. A possible remedy for his forgetfulness, Rousseau said, could have been to request that his fellow officers remind him to re-secure his gun.

"If you were a senior officer, you could've said, `Hey, make sure you get your gun before you walk out that door,'" Rousseau said, "just a co-worker saying, `Hey, get your weapon and make sure that it's on.'"

According to police records, Rousseau first forgot his weapon Feb. 19, 2005, when he borrowed Suchocki's patrol car to take a bank-robbery witness back to the scene. When Suchocki returned to his car, he discovered Rousseau's pistol in the front seat.

Rousseau received notice of his mistake, but he was not suspended, records show.

Three months later, Sgt. Robert Koistinen climbed into a patrol car and discovered a fully loaded Glock pistol in the center console, according to a report Koistinen filed. The butt of the gun was leaning against the bottom of the console and the barrel was pointed upward, he said.

"The console has numerous items in it, any of which could have possibly contacted the trigger, causing the pistol to fire," Koistinen said in the report.

A list of department weapons confirmed that the gun was assigned to Rousseau, who was disciplined with a five-day suspension.

According to a memo Rousseau filed with the department, he placed the gun in the console a day earlier before entering court to process a suspect. He had been struggling to remember to recover his weapon from lock boxes, in which officers are required to leave their guns while processing defendants, he said in the memo.

By the time he returned from court and responded to a building fire - without his gun holstered - he was "extremely tired both mentally and physically," he said in the memo.

Then, on Dec. 29, 2005, Suchocki noticed that Rousseau was not wearing his service revolver while inside the police department, Suchocki wrote in a report. Records show that Rousseau had forgotten his gun in the department's lock box that day during an arrest and then, for more than five hours, patrolled the town without it.

He was suspended for 10 days.

In the same month, Rousseau forgot a pile of reports in the police department's workroom, Capt. Chester DeGray wrote in a memo to him. On the same day the reports were returned to Rousseau and he was warned, he left one at the dispatch station unattended, records show.

Suchocki declined to comment on Rousseau's case, but in a letter notifying Rousseau of his 10-day suspension after the December incident, he said: "Your forgetfulness in retrieving your service weapon from the cell block area and then going out into the community not only endangered your own safety but the safety of the officers who were working."

Most of these émigrés were Jewish, however a lot of Russians faked a Jewish passport, among them Russian criminals. Most of the Russians settled in Brighton Beach in New York, which has got the largest Russian population outside of Russia.


When the Soviet Union fell apart Russian Organized Crime was unleashed unto the world. Russian Organized Crime can now be found everywhere, from the US to Israel to Spain. The Russians can be considered together with the Italians (Cosa Nostra, Ndrangheta, Camorra) and the Colombians to be the most powerful criminals in the world.

Russian criminals are active in: Fraud, transnational money laundering, extortion, drug trafficking, weapon smuggling, auto theft, white slave trafficking/prostitution, hostage taking, extortion of immigrant celebrities and sport figures, transportation of stolen property for export, insurance (staged auto accidents) and medical fraud (false medical claims), counterfeiting, credit card forgery, and murder.

One of three Boston police officers indicted last year on charges of protecting cocaine shipments for undercover FBI agents posing as drug dealers pleaded guilty today in federal court.

Carlos Pizarro, a 10-year veteran of the force who has been in custody since his July 2006 arrest, pleaded guilty to one count of conspiracy to possess with intent to distribute 100 kilograms of cocaine and a second count of possession with intent to distribute cocaine.

"Why are you pleading guilty?" asked US District Judge William G. Young, after advising Pizarro that he could face up to 24 years in prison if convicted at trial. The government was offering to recommend no more than 14 years under a plea agreement filed with the court.

"Looking at the alternative, what we agreed upon sounds better,'' mumbled Pizarro, whose 38th birthday is today. Dressed in an orange prison suit, with leg irons shackled around his ankles, he sat in the witness box next to the judge during most of the hearing, nodding solemnly when asked if he had knowingly conspired with the others to guard a truck loaded with cocaine.

The agreement does not require Pizarro to testify against his former partners in the motorcycle unit, Roberto "Kiko" Pulido and Nelson Carrasquillo, who are slated to go to trial Nov. 5. However, it does require him to provide the government with a detailed account of his own involvement in any crimes.

"Obviously this is somebody who is telling the court he's ready to be held accountable for his conduct,'' said Pizarro's lawyer, R. Bradford Bailey. "Hopefully he'll be able to get on with his life down the line.''

The three officers were arrested in Miami last summer when they showed up for what they allegedly believed was a celebratory meeting with drug dealers who were supposed to pay them the final $35,000 of $50,000 in payments for guarding 100 kilograms of cocaine in June 2006 while it was being trucked from Western Massachusetts to a Jamaica Plain garage.

    In case any of you have forgotten, this THEMIS Cydonia "city pattern" is a virtual twin for the discovery made by a similar "thermal IR scanner" aboard Russia's Phobos 2 spacecraft in 1989. A side by side comparison (above) clearly demonstrates that "Cydonia City" is NOT an isolated settlement, but rather part of what appears to be a planet wide, far-reaching civilization ...

    There can be no middle ground here. Architects and engineers will instantly recognize the form, fit and function of their craft in the objects scattered all throughout the THEMIS image. And even more, some of the features can be seen, just barely covered over, in the Odyssey visible light image … and even on the original Viking data. How "noise" could occupy the same area and location on images taken 25 years apart, by completely different instruments, and on completely different spacecraft … is going to be a tough hurdle for the usual suspects to clear. In addition, the MOLA data confirms that a great deal of Cydonia exists below the visible surface (why didn’t the MOLA scientists back at Goddard catch this years ago …?) -- precisely in the "basin" occupied by our frozen City.

    The laser can't lie.

    So Keith's version of the IR image -- the only one which is consistent with all the other observations -- must be the closest thing to the "real" data returned by the THEMIS instrument we have now in the public view (again, all this will be covered in even more detail in Richard's document).

    But there is one final point.

    We are pretty sure at this point that the "official" version has a visible light image layered over the top of the degraded multi-spectral THEMIS image. We don't have proof positive yet, but we are working on that. However, there are a couple of issues that fall out of that critical assumption.

    Iran Fined $2.65 Billion for Terrorism

    WASHINGTON - Iran must pay $2.65 billion to the families of the 241 U.S. service members killed in the 1983 bombing of the U.S. Marine barracks in Beirut, a federal judge declared Friday in a ruling that left survivors and families shedding tears of joy.

    U.S. District Judge Royce C. Lamberth described his ruling as the largest-ever such judgment by an American court against another country. "These individuals, whose hearts and souls were forever broken, waited patiently for nearly a quarter century for justice to be done," he said.

    Iran has been blamed for supporting the militant group Hezbollah, which carried out the suicide bombing in Beirut. It was the worst terrorist act against U.S. targets until the Sept. 11, 2001 attacks.

    Hundreds of people crowded into a federal courtroom to hear Friday's ruling. Parents have grown old since their children were killed. Siblings have grown into middle-age. Children have married and started families of their own.

    Weeping spectators stood and erupted in applause and hugs as Lamberth left the bench.

    The ruling allows nearly 1,000 family members and a handful of survivors to try to collect Iranian assets from various sources around the world. Finding and seizing that money will be difficult, however, and the families are backing a law in Congress that would make it easier for terrorism victims and their families to do so.

    Families were encouraged by Libya's decision to ultimately accept responsibility for the 1988 bombing of a Pan Am flight over Scotland. The country, once a pariah by Washington's view, agreed to compensate the families of the 270 victims. Part of the $2.7 billion has been paid. A final $2 million installment to each family is outstanding.

    "This is a sense of victory, of winning a battle," said Paul Rivers, who was a 20-year-old enlisted Marine on the second floor of the barracks when it exploded. "When we win the war is when we collect, when we make them pay for what they did."

    Iran has denied responsibility for the attack. The nation did not respond to the 6-year-old lawsuit and was represented only by an empty table.

    Family members said they hoped Friday's ruling would pressure foreign governments not to sponsor terrorism. Lynn Smith Derbyshire, whose brother, Vincent Smith, was killed in the attack, said countries won't stop until "it begins to actually cost them money to kill Americans."

    Some disagreed about whether that will happen. Roxanne Garcia-Bates, who was 16 when her brother, Randy Garcia, was killed, said she was surprised to find a sense of comfort being with the other families in court. She said she was pleased that Lamberth had made such a strong statement, but doubted that Iran would change anytime soon.

    "You can't take enough money away to get them to stop what they're doing," she said.

    All agreed that emotions remain raw to this day.

    Rivers described being one of the second floor's five survivors. All but him lost arms or legs, he said. He was buried in the rubble for two hours, he said. Debris had punctured his eardrum and "I literally had rocks inside my head."

    Shirley Murry of Baltimore, who was 16 years old at the time, described the tense days of waiting around the television for word of her brother, Ulysses Parker. Today, every time the news carries a story about a fallen soldier or an explosion overseas, she said it's like that first day all over again.

    Lamberth said the law "offers a meager attempt to make the surviving members whole." He said he hoped the judgment would alert Iran that terrorism has consequences and help in the families' healing process. Pausing, he added:

    "That's all I can do."

    Waterbury's police chief says he saw Sen. Louis DeLuca at least 20 times over a two-year period, and DeLuca never once mentioned that his granddaughter was being abused.

    Chief Neil M. O'Leary made that disclosure in a letter released Thursday by a special committee that is considering whether to expel DeLuca from the state Senate after he pleaded guilty to conspiring to threaten his grandson-in-law because he believed his granddaughter was being abused.

    O'Leary had already said publicly that he had met several times with DeLuca and his family members regarding the relationship between Casey Reilly Colella and her husband, Mark Vincent Colella. But the 13-point letter provides more details about O'Leary's conversations with DeLuca.

    Committee members said the recollections of O'Leary and DeLuca are important as senators try to determine exactly what happened in the time leading up to the threats against Colella, who has repeatedly denied abusing his wife. DeLuca, R-Woodbury, has publicly stated that he sought assistance from Danbury trash hauler James Galante only after being turned away by the Waterbury police because his granddaughter refused to file a complaint against Colella.

    Galante is awaiting trial on 93 criminal counts in a racketeering indictment that is based partly on FBI wiretaps conducted during an investigation of mob ties to the state's garbage-hauling industry. During an initial meeting in a diner in 2005 before Galante was indicted, DeLuca had asked for Galante's help in threatening Colella.

    "After speaking with Senator DeLuca in the spring of 2005, I saw him at least 20 times over the course of the next two years," O'Leary wrote in a three-page letter. "During that time, Senator DeLuca never raised the issue of Casey Reilly Colella and her relationship with her family, and I did not feel it would be appropriate to bring the issue up because Senator DeLuca had been so distraught in discussing the matter on prior occasions."

    DeLuca, who could not be reached for comment Thursday night, said recently that he still disagrees with O'Leary's recollections of their conversations.

    In another development, the committee released a letter from the Waterbury city attorney's office that said police received an anonymous complaint after DeLuca's guilty plea on the misdemeanor charge on June 4.

    Colella has told The Courant that Waterbury police arrived at his home after an anonymous complaint alleged that his wife was suffering from physical abuse. The police arrived, questioned both Colella and his wife separately, and then checked Casey for bruises, Colella said. The police then left. O'Leary had previously declined to comment on Colella's account, but the letter from the city attorney's office mentioned the complaint made in the case.

    "The allegations which were investigated were found to be unsubstantiated," attorney Janis M. Small wrote in the letter to the Senate committee. "The police report regarding this investigation is, therefore, exempt from disclosure" under state law that blocks public release of uncorroborated allegations.

    The disclosures did not cause any immediate reaction from the committee because Sen. Andrew Roraback, R-Goshen, the committee co-chairman, said that committee members should not comment in the same way that a judge should not comment on a case after the first day of a trial.

    In his own letter, O'Leary said he has known DeLuca and his family for most of his life because he attended school with DeLuca's children in their hometown of Woodbury. Two of Casey Reilly's aunts - Mary Beth Mecca and Sharon Reilly - asked to meet with O'Leary in January 2005 to discuss Casey's relationship with Colella, but they never mentioned abuse, O'Leary said. He also described talking with DeLuca during the St. Patrick's Day parade in the Washington Hill section of Waterbury in 2005.

    "I next saw Senator DeLuca in April or May of 2005, and he advised me that not only was Casey Reilly Colella living with Mark Colella, he also learned that they were secretly married and that she was also pregnant," O'Leary wrote. "Senator DeLuca expressed extreme displeasure with this relationship. Senator DeLuca never indicated to me during the course of this conversation that he felt Casey Reilly Colella was in an abusive relationship."

    The six-member committee's next meeting is scheduled for Sept. 20 at the Legislative Office Building in Hartford.

    Caught on tape - Mass. State Police Making Illegal Arrest



    Massachusetts Attorney General's office and State Police have attempted to block this video from being posted on the internet with the threat of felony charges.

    The "nanny cam" video shows the state police making an illegal arrest of Paul Pechonis and a search of his home.

    A cease and desist letter with 48 hours notification was issued by Massachusetts State Police, Deputy legal Counsel Ms. Ann McCarthy on February 14, 2006. The letter claims under an organized crime statute MASS. GEN. L. ch. 272 § 99 that the display of the video is punishable as a felony.

    The Conte2006.com web site was ordered to stop the display of a video which captured Worcester District Attorney John J. Conte's Auburn State police C-Pac unit arresting Paul Pechonis under a misdemeanor warrant for threats to commit a crime (murder) some 30 days after a poster was discovered in Westborough District Court.




    The web site filed in US District Court for a Temporary restraining order, which was granted, thus allowing the video to remain on the web site peding a final hearing.

    A police officer who was fired after being convicted of careless driving claims he was caught between two unwritten rules of the road: Police don't hassle fellow officers, and nobody passes a state trooper especially on the right.

    Former Tinton Falls detective Gary Wade is suing over an incident that left him pepper-sprayed and handcuffed face-down on the side of a road. His lawsuit seeks $1 million from two state troopers and his own former department, his lawyer said at a news conference Wednesday.


    Wade, 31, maintains that he was pulled over for no reason while driving to work in an unmarked police car.

    The arresting state officer says he was provoked.

    The August 2004 encounter was recorded by the trooper's dashboard-mounted video camera and a microphone attached to the trooper's lapel.

    On the audio recording, Wade is heard repeatedly telling Trooper Michael Colaner to wait until a Tinton Falls police supervisor arrives before taking any further action.

    "He was talking cop-to-cop," Wade's lawyer, Susan Chana Lask, told reporters. Asked why Wade didn't simply hand over his identification or immediately state that he was a police officer, Lask said Wade pointed to his badge on his belt.

    "It's not a special privilege," she said. "It's just known between them."

    State Police Capt. Al Della Fave painted a much different picture. He said Colaner and his partner were driving a marked patrol car in the left lane when Wade's car zoomed up behind them and tailgated them before swerving to the right and passing.

    Wade was argumentative when they stopped him and ignored repeated requests to show identification, according to the officers' reports.

    "If he expected some special treatment for careless driving and refusing to identify himself, that will not happen, not for a police officer or for any civilian," Della Fave said.

    Lask called Colaner "a cop gone wild" and said of Wade, "He's upset that his so-called brothers would do this to him."

    "The actual reason he was stopped is because he passed the state trooper vehicle on the right," Lask said. "Officer Wade informed me it's a known fact among officers that you never pass a state trooper vehicle; you let them pass you. They don't like that."

    Lask said Wade demanded that a police supervisor come to the scene and refused to surrender his gun because he feared for his safety.

    Wade was charged with obstruction of justice, careless driving and resisting arrest. He was convicted in municipal court of the first two offenses, and fired. Wade, who also is appealing the convictions, now works as a contractor and has no desire to be reinstated as a police officer.

    Della Fave said two courts and an internal State Police probe have all concluded the trooper acted appropriately.

    Guy Hamilton Jones, Sr. - Democrat -Arkansas State Senate. Convicted on federal tax charges and expelled from the Arkansas Senate.

    Daniel Flood - Democrat - U.S. Representative from Pennsylvania from 1945 to 1947, 1949 to 1953 and 1955 to 1980. Pleaded guilty to a conspiracy charge involving payoffs and sentenced to probation.

    Otto Kerner, Jr - Democrat - Governor of Illinois from 1961 to 1968. While serving as Governor, he and another official made a gain of over $300,000 in a stock deal. Convicted on 17 counts of bribery, conspiracy, perjury, and related charges. Sentenced to three years in federal prison and fined $50,000.

    George Crockett, Jr. - Democrat - U.S. Representative from Michigan. Served four months in federal prison for contempt of court following his defense of a Communist leader on trial for advocating the overthrow of the government.

    Cornelius Edward Gallagher - Democrat - U.S. Representative from New Jersey from 1959 to 1973. Indicted on federal charges of income tax evasion, conspiracy, and perjury

    Mark B. Jimenez - Democrat fundraiser - sentenced to 27 months in prison on charges of tax evasion and conspiracy to defraud the United States and commit election financing offenses.
